Welcome to BorderPrint. These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the website www.borderprint.com (the "Site") and the purchase of any products or services offered by Border Connect Inc. doing business as BorderPrint ("BorderPrint", "we", "us", or "our").

By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.

1. General Conditions

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence and have the legal authority to bind the business entity on whose behalf you are purchasing. We reserve the right to refuse service to anyone for any reason at any time.

2. Products and Custom Orders

BorderPrint specializes in custom-printed cross-border compliance products, including but not limited to PARS/PAPS barcode labels, lead sheets, and digital documents.

  • Customer Responsibility for Accuracy: When placing a custom order, you are strictly responsible for providing accurate information, including your Standard Carrier Alpha Code (SCAC), Carrier Code, company name, starting barcode sequences, and any other required data.
  • Proofing and Printing: We print exactly what is provided at the time of order. We are not responsible for spelling errors, incorrect carrier codes, or inaccurate numbering sequences provided by the customer.
  • Agency Compliance: While our labels are designed to meet the technical specifications of the Canada Border Services Agency (CBSA) and U.S. Customs and Border Protection (CBP), you are solely responsible for ensuring that your use of these products complies with all current government regulations.

3. Returns, Refunds, and Replacements

Due to the custom-made nature of our products, we do not accept returns or offer refunds on printed orders unless there is a verifiable manufacturing defect or an error made on our part.

  • Manufacturer Errors: If BorderPrint makes an error in printing that deviates from the information provided in your order, we will reprint and ship the corrected labels to you at our expense as quickly as possible.
  • Customer Errors & Order Modifications: It is your responsibility to review your order details carefully prior to submission. If you discover an error after placing your order, you must contact us immediately to rectify it. If no attempt to rectify the error(s) is made promptly, and the order has already been processed and fulfilled by our team, no refunds or free replacements will be provided. In such cases, you will be required to place a new order with the correct information.
  • Digital Products: Due to their nature, all sales of digital downloads (e.g., Digital PARS/PAPS) are final and non-refundable.

4. Shipping and Delivery

  • Fulfillment Times: We strive to process and print orders as quickly as possible. Estimated processing and shipping times are provided at checkout but are not guaranteed.
  • Carrier Delays: Once a physical order leaves our facility, we are not responsible for delays caused by third-party shipping carriers (e.g., UPS, FedEx, Canada Post, USPS), weather conditions, or customs clearance processes.
  • Customs and Duties: For physical orders shipped across international borders, the customer is responsible for any applicable import duties, taxes, or brokerage fees.

5. Limitation of Liability

Please read this section carefully, as it limits our liability to you.

In no event shall Border Connect Inc. dba BorderPrint, its directors, officers, employees, or affiliates be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of our products or Site.

This includes, but is not limited to:

  • Delays at border crossings.
  • Fines, penalties, or fees assessed by the CBSA, CBP, or any other government agency due to rejected or unreadable barcodes, incorrect carrier codes, or improper use of our products.
  • Loss of profits, loss of freight revenue, or missed delivery windows.

Our maximum liability to you for any claim arising out of or relating to your order shall not exceed the total purchase price paid by you for the specific products in dispute.

6. Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is the property of Border Connect Inc. dba BorderPrint or its content suppliers and is protected by Canadian and international copyright and intellectual property laws. You may not reproduce, duplicate, copy, sell, or exploit any portion of the Service or Site without express written permission from us.

7. Pricing and Payment

  • Prices for our products are subject to change without notice.
  • We reserve the right to modify or discontinue a product at any time.
  • Payment is required in full at the time of purchase. We use secure third-party payment processors and do not store your full credit card information on our servers.

8. Privacy

Your submission of personal and business information through the store is governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.

9. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the courts located in Windsor, Ontario, Canada.

10. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website following the posting of any changes to these Terms constitutes acceptance of those changes.
